Distortionary end-user license

Draft. This license governs the Distortionary filters, plug-ins, panels, command-line tools and desktop application sold on this site (“the software”).

1. Grant of license

Purchasing a license grants a non-exclusive, non-transferable right to install and use the software under the terms of the tier purchased. The software is licensed, not sold.

2. License tiers

Single filter: one user, one filter, as a GIMP plug-in and Photoshop panel, on any number of that user’s own computers.
Complete set: one user, every filter's GIMP plug-in and Photoshop panel, and the desktop application, on any number of that user’s own computers.
Studio: the complete set for up to ten users within one organization.
Enterprise: the complete set plus the command-line tools and libraries, for batch, server, hosted or embedded use, including shipping the libraries inside another product, on terms agreed per organization. The command-line tools and libraries are licensed only under this tier.

3. Your images

Images, video frames and other output you make with the software are yours. You may use them for any purpose, commercial or not, without attribution or further payment.

4. What’s not permitted

Redistributing, reselling or sublicensing the software, in original or modified form.
Offering the software’s functions to third parties as a hosted service without an Enterprise license.
Sharing one single-user license among several people.

5. Beta pricing and updates

Software sold during beta is priced below its 1.0 price. A license bought at the beta price remains valid for all 1.x releases at no additional cost. Complete-set licenses bought during beta include filters added to the set before 1.0.

6. Term and termination

This license remains in effect until terminated. It terminates automatically if you breach any term and do not cure the breach within 30 days of notice. On termination you must stop using the software and delete all copies. Sections 3, 7 and 8 survive termination; images already made remain yours.

7. Warranty disclaimer

The software is provided “as is,” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, Distortionary is not liable for any indirect, incidental, special, consequential or punitive damages arising from use of the software. Total liability under this license is limited to the amount you paid for it.

9. Refunds

Refunds are available for 14 days from purchase.

10. Changes to this license

These terms may change for future purchases. A change never reduces the rights granted under a license you already hold.

Common questions

Do I own the images I make?: Yes. Output is yours to use commercially, with no attribution and no royalties. The license covers the software, not what you make with it.
Which hosts does one purchase cover?: GIMP, Photoshop and the desktop app. A filter is licensed once and runs in each of them, on as many of your own machines as you use. The command-line tools come only with Enterprise.
What happens when 1.0 ships?: A license bought at the beta price stays valid, and 1.x updates are included. You never pay the difference.
Can I script the filters or run them on a server?: Yes, with an Enterprise license. It adds the command-line tools and libraries, and covers batch jobs, render farms and hosted use. Get in touch for pricing.
Can I try before buying?: Every filter runs live on its page, in your browser, on your own photograph. Nothing is uploaded.
Is macOS supported?: The Photoshop panels run on macOS today. The desktop app and the GIMP plug-ins run on Linux and Windows; macOS builds of both follow.
Refunds?: 14 days from purchase, no questions.
